Just another misdirection move by the Biden White House in their insidious all reaching weaponization of the justice system.

I will give him one thing though, he didn't flip and sell his father down the river and take out the entire operation.

        1. iamr4man

According to Dr. Phil there’s no such thing as flipping and using it against Trump was completely wrong and unique. So unfair to him.

I would hope that probation, and perhaps a small fine, is the sentence.

Frankly, for anyone writing a book/and an audio book where you admit to multiple felonies, within the statute of limitations, is not bright....

Has anyone not named Biden ever been prosecuted for admission to drug crimes in an autobiography since the 1950s?

  3. kahner

Yeah, this was pretty clearly a politically driven prosecution but once it got in front of a jury the law and the evidence were pretty clear cut. I'm guessing he'll appeal though, so who knows how long this will take before final resolution.

    1. memyselfandi

He would be an idiot to not appeal the constitutionality of the law. He couldn't have been prosecuted in the states of Oklahoma, Utah, Louisiana, Mississippi or Texas.

Even Trey Gowdy said when he was a federal prosecutor they never prosecuted this kind of gun crime involving an addict who didn’t use the gun to commit other crimes or didn’t have a record.

My understanding -- any lawyers reading this, please correct me as needed -- is that the federal system has fairly restrictive rules about the range of possible sentencing options, based on a whole list of factors like previous criminal record. If that's the situation here, does anybody know what would be a typical sentence indicated for someone in these same circumstances?

Hunter Biden was prosecuted for a crime that is basically never charged as a stand-alone offense, especially for first time offenders who have no prior record. And even when it is charged, it’s an offense that is usually occupied by other more serious crimes (eg the gun was purchased and then used to hold up a convenience store) which results in a plea bargain to this specific crime-of-lying-on-a-form almost 100% of the time. So there is no “typical” sentence, in the sense of “this is what first time offenders found guilty of the same offense typically get.” The universe of “people convicted of lying on Form 4473 and nothing else” might solely contain Hunter Biden and nobody else on earth.

The sentence will make it clear just how politicized the judge — a Trump appointee — really is. I couldn’t believe Hunter wasn’t allowed to have an expert witness testify to how addicts who have come out of rehab typically think. Hunter’s intent was key to the case. If he truly believed he had his addiction under control when he signed the form then he should have been acquitted. It’s clear the law doesn’t use the “once and addict always and addict” standard.

The jury was split — six in favor of convicting Hunter Biden on federal gun charges, six who initially wanted to render a not guilty verdict, according to the juror.

When the jury came back Tuesday morning, the next vote was 11-1, with 11 people saying they thought the prosecution proved its case beyond a reasonable doubt, the juror said to CNN’s Hannah Rabinowitz. -- CNN

Having sat on juries before, I think many decisions are guided by the strength of the person or persons who, through deliberations, end up being leaders of the jury. I think this jury could have returned a not-guilty finding on all three charges if there was one very strong leader among the not-guilty members.

Was ATF Form 4473 - the one Hunter “lied” on - in use in 1787? If not, hopefully Clarence Thomas will be brave enough to defend Second Amendment rights yet again on behalf of someone unduly burdened by requirements not in existence when the Founding Fathers wrote the Constitution. It’s not like Uncle Thomas is a partisan hack, right?

    1. aldoushickman

I used to joke that you could generate Thomas dissents/concurrences via a fill-in-the-blanks template:

"I concur with my brother Justice [SCALIA], but would go farther. There is no [X] in the Constitution; ergo [X] is unconstitutional."

Sadly, that was in the days of yore where Thomas's views didn't hold a majority of the Court . . .

A poll yesterday showed that 34% of Republicans are not aware that Trump has been indicted for conspiring to overturn the presidential election. I suspect 134% of Republicans will soon be aware that Hunter Biden was indicted, tried, and convicted on gun charges.

Based on a conversation I had with some Trumpers yesterday, who assured me that Joe Biden has 0% of winning the election in November, this projection may come as a surprise to many Republicans:

538 currently gives Biden a 53% chance of winning the election.

    Biden wins: 531
    Trump wins: 466
    No winner: 3

That's the result of 1,000 simulations using the 538 forecast model and current data (polling, economic, demographic).

    1. MrPug

I highly recommend you ignore every big data science-y approach to predicting the out comes of elections. They are complete and utter bullshit.

Yah, it's been interesting to see the gun fondlers struggling to say anything sensible about the Hunter Biden case. On the one hand, they are happy to see any D prosecuted for any crime under the sun. But on the other hand, they all know perfectly well that 10's of millions of good red-blooded Americans are probably guilty of the exact same crime as Hunter. They do NOT want this prosecution to become a trend.

    2. memyselfandi

This was a joke. trump would never, ever say that. The whole reason Trump sas his charges are created out of whole cloth b Biden is that is what he intends to do and he can;t comprehend that everyone else isn't as evil as he is. His belief that the veterans who stormed the beaches of Normandy were sucker is a sincere (and evil) one. (And naturally come by. At the time his father was taking massive contracts to build military housing that turned out to never be inhabitable. By the standards of the people who lived in the trenches of WW1)

There is a long list of folks that Trump and his merry band of fascists have insisted needed to be jailed, and I would expect that if sleepy Joe loses in November, he will also have a long list of pardons to protect those same people, which would likely include Hunter.

Want to really see what weaponizing the DOJ really looks like, just wait until 2025.

      1. KJK

Joe says he won't pardon Hunter, but if he receives any jail time and if Joe loses in November, I would not be shocked if he pardon's or commutes the sentence, to keep Hunter out of the hands of Il Duce's DOJ.

You know who doesn't have to worry about some whackadoodle on the Internet taking revenge? The judge, jury, and prosecutor.

Sadly, it's not always the case in felony cases of political figures.

  10. Salamander

Okay, so now that the 4473 rules and any use/addiction to (there's no difference, is there?) of drugs that are FEDERALLY illegal is a felony, it's time to track down and prosecute

    * Everybody who bought a gun and has ever had a "medical marijuana" card
    * Everyone who bought a gun and is living in a legalized marijuana state. Maybe check to see if they've bought any? Maybe.
    * Everybody with opiate prescriptions.

Because DRUGS!! invalidate the Second Amendment! Amirite??

  11. iamr4man

Here’s the difference between Biden and Trump. Note that some of the jurors have already spoken out about their verdict. They have no concern of Joe Biden calling them names and no worries that those of us that support him and think this prosecution of his son was bullshit will threaten their lives and their families. I hope this is pointed out in the MSM but I doubt it will be.

    1. KJK

Big difference between Biden and Trump is that Joe went to see his son after the verdict and there was a warm, heartfelt embrace between a father and his son. The only embrace from Trump for anyone would be in the act of a sexual assault.
