Hunter Biden is guilty!!!

Well, he's guilty of two misdemeanor charges of paying his taxes late. He did pay the taxes, he just didn't pay them on time.

Biden Jr. also avoided prosecution on a sketchy gun charge.¹ He was instead admitted to a diversion program, which is pretty common for first-time offenders. Together, this apparently ends the Biden investigation completely, including all the frantic claims that Biden took bribes, paid off his father, got a Ukrainian official fired, etc.² Politico has the details:

"It is my understanding that the five-year investigation into Hunter is resolved," Hunter Biden’s attorney Christopher Clark said in a statement....The plea agreement is intended to be a comprehensive resolution of Hunter Biden’s potential legal liability in all matters investigated by federal authorities, a person familiar with the negotiations said.

As usual, it's worth noting that the investigation of Hunter Biden was overseen by a Republican who was appointed by Donald Trump. David Weiss spent five years on it.

Also as usual, Weiss was approved on a voice vote in 2017 and no one seemed to have any problem with his appointment at the time.

But yet again, as usual, Republicans are now crying foul. Donald Trump: "Our system is BROKEN!" Rep. James Comer: "The Department of Justice’s charges against President Biden’s son Hunter reveal a two-tiered system of justice . . . We will not rest until the full extent of President Biden’s involvement in the family’s schemes are revealed." Speaker Kevin McCarthy: "If you are the president’s son, you get a sweetheart deal." Rep. Doug LaMalfa: "There needs to be a thorough investigation of . . . the Justice Department’s handling of the investigation." Rep. Elise Stefanik: "It’s never been more clear that we have a two-tiered system of justice . . . House Republicans will not rest until the full illegal corruption of the Biden Crime Family is exposed." Rep. Mary Miller: "The cash & diamonds he didn't pay taxes on came from CHINA, RUSSIA & UKRAINE. No FARA foreign agent charges? TWO SYSTEMS OF JUSTICE!" Gov. Ron DeSantis: "If Hunter was not connected to the elite DC class he would have been put in jail a long time ago."

The Republican keywords for the day are "two-tiered," "sweetheart deal," "slap on the wrist," and "elite DC class." More to come, I'm sure.

¹ATF was reluctant to even work the case from the start. Hunter was on drugs, tossed a gun away in a dumpster but did it badly, and agreed to rehab. Anyone else probably would have been given a warning and let go.

      Well, Hunter lied about not being on certain drugs when he filled out his application. I don't know whether that's a misdemeanor or not, but I get the impression that a lot of people commit the same offense, most of them MAGA types.

        The gun charge, per MoJo at least, seems to have been a felony. They don’t say however what class/grade/whatnot felony.

    I'm sure all the media outlets will note that this prosecution started under Trump and was done by a Trump appointed prosecutor. And when Republicans make comments, this fact will be brought to their attention. Yep.

    The national crime population is so invested in their fantasy that everyone else is even guiltier than they are, especially any Democrats, especially the Bidens, I think there may be riots. At least there will be histrionic House investigations and dozens of belligerent psychos trying, not on purpose at all, to cause some feeble minded idiots to try and shoot Hunter Biden.

    Right now he may be one of the few people who actually needs a gun for self-protection.

      Perhaps. Particularly if the IRS had the number of agents and funding many want them to have. Or at least audited.
      Would we have heard about them? Almost certainly not.

    If Hunter Biden were Republican, he'd have taken his unpaid taxes and illegal gun and held some federal land hostage, and all the GOP would have cheered.

    I just can't believe the dissonance the Republicans exhibit. Full stop. Invert that. I CAN believe the dissonance. Two tiers of justice?! An AirNaty Guardsmen, very junior I might add, is on the greased rails to prison because he was showing off to a very small audience for a very short period of time meanwhile in Florida...

      A unclothed Republican with a gun wouldn't be considered naked, although a fully clothed Republican without a gun might be.

    If you're a Christian, and I'm guessing all of those Republican comments come from people that identify as Christian, then you'd believe in "do unto others as you would have others do unto you."

    I prefer Bob Dylan's version: don't criticize what you can't understand.

    Another version is the scientific principle: examine the evidence and then draw an evidence-based conclusion.

    Knowing that you have to understand the evidence first, and then draw an evidence-based conclusion, is like knowing that you have to stop at a red light and wait for it to turn green. My sense of it is that the large majority of people that identify as religious and/or scientific would pass the knowledge test, but then they fail miserably on the road test. Maybe the world would be a better place if they got fined.

    For what it's worth, if it were up to me, I wouldn't be fining Kevin. But who doesn't need to be pulled over on occasion and given a warning? According to Matthew 15:21-28, not even Jesus.

    One interesting feature of our system is that any time we need to investigate a high level politician or someone close to a high level politician, the investigation must be conducted by partisan Republicans.

    The U.S. attorney for Delaware, David Weiss, just posted a statement on the Hunter Biden agreement that provided a terse recap of the deal outlined in court filings, with one unexplained addendum: “The investigation is ongoing.” A call to his spokesperson for further explanation was not immediately returned.

    In the settlement, H. Biden must agree never to own a firearm again. But given that The Supremes have declared that we all have a constitutional right to all the guns we want, isn't it unconstitutional to deprive Hunter of that right? And could the maganauts really complain when, in a few years, Hunter sues the government to force them to let him have a gun? Isn't this just a woke trick by the Deep State to begin the confiscation of all guns?

      All excellent points! Apparently, the second amendment only applies to white folk --unless they're Democrats. Or in a Democratic family. Yeah, them's the rules and I'm sure Sammie the Knife Alito would totally uphold them.

      Possibly, though I'm not sure voluntarily giving them up is the same as "being deprived" of said right.

    Crystal Mason was sentenced to 5 years in prison for voting using a provisional ballot that was not counted. Four Florida residents of “The Villages” pled guilty to voting twice and were sentenced to attend a civics class and pay $500. Two tiered, indeed.

    What interests me is that Republicans are claiming a two tiered system as if Trump has been convicted and sentenced to a harsher sentence. I suppose he might be able to obtain a similar “sweetheart” deal if he pleads guilty to some of the charges. I hope, but don’t expect, the people who are claiming a two-tiered system are asked if they think Trump should plead guilty in return for no jail time.

    This actually does reflect a multi-tiered judicial system. However, Trump is in the same (or similar) tier as Hunter.

    You're not going to get the same outcome if you're poor and unable to access attorneys who specialize in the crime(s) you're accused of committing.

    IMO, there is an overzealous weight of prosecution applied to the poorest, made heavier by minimum sentencing guidelines and the underfunding of public defenders.

      Poor people are very unlikely to get into tax trouble resulting in criminal charges, simply because they have little or no tax liability. When is the last time a server was prosecuted for under reporting their tips?

    I don't get the "two tier" stuff at all. Trump's been free to plead guilty and negotiate a deal any time during his various investigations. I'm sure the author of 'The Art of the Deal' would have made the best plea bargain anyone ever saw.

    BTW people assuming that Hunter would have been convicted of the firearm offence are assuming facts not in evidence. It's by no means certain the DoJ could have proved he lied on his form, and in the light of recent federal court decisions, there's an argument he could have had the charge thrown out as an unconstitutional infringement of his 2nd amendment rights.

    I think the Hunter Biden template actually points to a nice template for Donnie: plead guilty and avoid prison in exchange for probation.

    (The terms of probation, of course, being that he agrees to stay away from politics; and if violates the terms he's thrown in jail. That's more or less the Spiro Agnew approach.)

    I wonder how the tax thing became a criminal case?

    Many years ago, when I was young and dumb, I got several years behind on filing/paying my income taxes. Eventually the IRS got pretty crabby about it. I hired an accountant, prepared and filed the returns, paid what I owed with a very small penalty tacked on, and that settled the matter.

    People do this all the time. How does it become a criminal charge?
